Fovelox Terms of Use

These Terms of Use constitute an end-user license agreement ("EULA") between you and Fovelox ("Developer"), governing your use of the Fovelox iOS app and Fovelox website. By using Fovelox, you agree to these terms. This EULA is between you and the Developer only — not with Apple Inc. The Developer, not Apple, is solely responsible for the Fovelox app and its content.

1. What Fovelox does

Fovelox helps you review, organize, and clean up photos on your iPhone. Features may include swipe review, album organization, duplicate and similarity grouping, blurry photo detection, screenshot cleanup, video triage, progress tracking, and paid Pro features.

2. License grant

The Developer grants you a limited, non-transferable license to use Fovelox on any Apple-branded device you own or control, as permitted by the Apple Media Services Terms and Conditions. This license does not allow you to use Fovelox on a device you do not own or control. You may share access via Family Sharing or volume purchasing where permitted by Apple.

3. Your responsibility for photo decisions

You remain responsible for decisions you make in the app, including keeping, deleting, favoriting, organizing, restoring, or permanently deleting photos. Smart Cleanup suggestions are informational and may not be perfect. Review selections before deleting or permanently removing photos.

4. Photos, backups, and Recently Deleted

Fovelox uses iOS Photos actions. Deleted photos normally move to Recently Deleted in the Photos app, where Apple may keep them recoverable for a limited period. You are responsible for managing iCloud Photos, device backups, Recently Deleted, and permanent deletion decisions.

5. App Store terms and acknowledgement

Fovelox is distributed through Apple's App Store. This EULA is concluded between you and the Developer only, and not with Apple. Apple is not responsible for Fovelox or its content. Apple has no obligation to provide any maintenance, support, warranty, or other services with respect to Fovelox. In the event of any failure of Fovelox to conform to any applicable warranty, you may notify Apple and Apple will refund the applicable purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Fovelox. The Developer, not Apple, is responsible for addressing any product liability claims, regulatory claims, or consumer protection claims relating to Fovelox. Your use of Fovelox is also subject to Apple's App Store terms and conditions.

6. Paid features and subscriptions

Fovelox may offer paid features, subscriptions, trials, or one-time purchases. Pricing and availability can change. Subscription renewals and cancellations are managed through your Apple ID subscription settings. Access to paid features may depend on a valid purchase, subscription status, and App Store availability.

7. Acceptable use

You agree not to misuse Fovelox, interfere with the app or website, attempt to bypass purchase or security features, reverse engineer the app except where law permits, or use the website in a way that disrupts hosting or support operations.

8. Intellectual property

Fovelox, the Fovelox name, logo, app design, website design, text, graphics, and software are owned by the Developer or its licensors. These terms do not transfer ownership to you. You may use the app and website only as permitted by these terms and applicable app store rules. In the event of any third-party claim that Fovelox or your use of Fovelox infringes a third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Third-party services and terms

Fovelox may depend on Apple platform services such as Photos, iCloud Photos, App Store purchases, subscriptions, and device settings. Those services are controlled by Apple and governed by Apple's terms and policies. When using Fovelox in connection with any third-party service, you must comply with the applicable third-party terms of agreement.

10. Product claims

The Developer, not Apple, is responsible for addressing any claims you or any third party may have relating to Fovelox, including: (i) product liability claims; (ii) any claim that Fovelox fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11. Legal compliance

By using Fovelox, you represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

12. Support

Support is provided by the Developer through support@fovelox.app. We try to respond helpfully, but we do not guarantee response times, issue resolution, or continued availability of every feature. Apple has no obligation whatsoever to provide any support services with respect to Fovelox.

13. No warranty

Fovelox is provided on an "as is" and "as available" basis. The Developer does not promise that the app or website will be uninterrupted, error-free, or that cleanup suggestions will always be complete or accurate. In the event Fovelox fails to conform to any applicable warranty, you may notify Apple for a refund of the applicable purchase price. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to Fovelox.

14. Limitation of liability

To the maximum extent permitted by law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of photos, data, profits, goodwill, or device availability arising from use of the app or website.

15. Changes to Fovelox

We may change, suspend, or discontinue features, pricing, pages, or support options. We may also update these terms. Continued use after changes means you accept the updated terms.

16. Governing law

These terms are governed by applicable law, without regard to conflict of law principles, except where consumer protection law requires another jurisdiction's law to apply.

17. Third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of these terms, Apple will have the right to enforce this EULA against you as a third-party beneficiary thereof.
